WickedTrades Terms of Service

These Terms of Service ("Terms") govern your access to and use of WickedTrades, including the WickedTrades website, marketplace, messaging features, seller services, and related services (collectively, the "Service").
By creating an account, accessing the Service, purchasing a seller subscription, posting a listing, communicating with another user, or otherwise using WickedTrades, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
1. About WickedTrades
WickedTrades is an online marketplace designed to help people discover, list, buy, sell, and discuss goods available in their local communities.
Unless WickedTrades expressly states otherwise, WickedTrades is not the buyer or seller of items listed by users.
Buyers and sellers are responsible for evaluating listings, communicating with one another, agreeing on transaction terms, inspecting goods, arranging delivery or pickup, and completing their transactions.
2. Eligibility and Accounts
You must be legally capable of entering into these Terms to use WickedTrades.
You agree to provide accurate information when creating and maintaining your account. You are responsible for maintaining the security of your password and account.
You may not impersonate another person, create accounts for fraudulent purposes, or use another person's account without authorization.
3. Listings
Sellers are responsible for their listings and must provide reasonably accurate information about the item, including its description, condition, price, category, location, photographs, and availability.
You must have the legal right to sell any item you list and must not deliberately misrepresent an item's condition, authenticity, ownership, origin, features, or value.
4. Prohibited Items and Conduct
You may not use WickedTrades to advertise, sell, purchase, request, facilitate, or promote goods or activities prohibited by applicable law or WickedTrades policies.
You may not use the Service for fraud, scams, deceptive conduct, harassment, threats, illegal activity, spam, unauthorized commercial solicitation, or attempts to compromise the Service.

5. Marketplace Transactions
Buyers and sellers decide whether to enter into a transaction. WickedTrades may provide tools for offers, accepted deals, transaction status, messaging, and other marketplace features.
These features facilitate transactions between users and do not generally make WickedTrades a party to the purchase agreement between buyer and seller.
Unless expressly stated otherwise, payment for marketplace goods occurs between the buyer and seller using a lawful payment method they mutually agree upon.
6. Safety
Users are responsible for deciding when, where, and how to meet another user.
When practical, consider meeting in a public place, inspecting goods before payment, and avoiding payment arrangements you do not understand or trust.

7. Seller Subscriptions
Certain seller features may require a paid WickedTrades Seller subscription.
Subscription pricing and applicable billing terms will be disclosed before purchase. Seller subscriptions may renew automatically according to the terms presented during checkout until cancelled.
Payment processing may be provided by third-party processors such as Stripe. WickedTrades does not directly store complete payment-card information when payment information is handled by the payment processor.
Cancellation generally prevents future renewal but does not necessarily entitle the subscriber to a refund for an already-paid period, except where required by law or expressly stated by WickedTrades.
8. Messaging
WickedTrades may allow users to communicate directly through the Service.
Messaging may not be used for harassment, threats, spam, fraud, prohibited transactions, malicious content, or violations of another person's privacy.
9. Reviews and Reputation
WickedTrades may provide ratings, reviews, completed transaction information, response information, verification indicators, or other reputation features.
These features may help users make decisions but are not guarantees or endorsements by WickedTrades.
10. Location Information
WickedTrades may provide features such as nearby listings, distance calculations, radius searches, and location-based saved searches.
Location and distance information may be approximate. Sellers' precise coordinates may be used internally to support these features while buyers may see a city, region, or approximate distance.
11. Saved Searches and Notifications
Users may save marketplace searches and receive notifications when new listings appear to match selected criteria.
WickedTrades does not guarantee that notifications will be immediate, complete, accurate, or successfully delivered.
12. User Content
User Content includes listings, photographs, descriptions, reviews, profile information, reports, messages where applicable, and other content submitted through the Service.
You retain ownership of your User Content.
By submitting content for use through WickedTrades, you grant WickedTrades a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, and otherwise use that content as reasonably necessary to operate, secure, improve, and promote the Service.
13. Intellectual Property
The WickedTrades name, branding, logos, software, interface, designs, and original content are owned by WickedTrades or its licensors and may be protected by applicable intellectual property laws.
14. Reports and Moderation
WickedTrades may investigate reports and take actions such as warning users, hiding or removing listings, restricting features, suspending accounts, or terminating accounts.
WickedTrades is not obligated to resolve private disputes between buyers and sellers.
15. Suspension and Termination
WickedTrades may suspend, restrict, or terminate access where reasonably necessary to address suspected fraud, security threats, illegal conduct, policy violations, risks to users, or abuse of the Service.
16. Privacy
Use of WickedTrades is also governed by the WickedTrades Privacy Policy.
17. Third-Party Services
WickedTrades may depend on third-party providers for payment processing, email, hosting, databases, file storage, geocoding, or other infrastructure.
Third-party providers may have their own terms and privacy practices.
18. Service Availability
WickedTrades may update, change, suspend, discontinue, or restrict portions of the Service.
WickedTrades does not guarantee uninterrupted or error-free operation.
19. No Guarantee of Users or Listings
WickedTrades does not guarantee that listings are accurate, items are authentic or safe, sellers own listed goods, buyers will pay, sellers will complete transactions, or other users will behave appropriately.
Users are responsible for exercising their own judgment.
20. Disclaimer of Warranties
To the maximum extent permitted by applicable law, WickedTrades and the Service are provided on an "as is" and "as available" basis.
Nothing in these Terms excludes warranties, remedies, guarantees, or consumer rights that cannot lawfully be excluded.
21. Limitation of Liability
To the maximum extent permitted by applicable law, WickedTrades will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Service or transactions between users.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
22. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless WickedTrades and its operators from third-party claims arising from your unlawful use of the Service, your listings, your violation of another person's rights, or your material breach of these Terms.
23. Changes to These Terms
WickedTrades may update these Terms from time to time. Where required, users will receive appropriate notice of material changes.
24. Governing Law
These Terms are governed by the applicable laws of New Brunswick and the federal laws of Canada applicable therein, without excluding mandatory consumer protections that apply based on a user's location.
